Bystanders who witness sexual harassment or misconduct have the right to report it. ÀÖ²¥´«Ã½ employees, including student employees, are considered and are required to report any sexual misconduct they witness or are told about, unless they are a . Employee bystanders who report misconduct are protected from workplace retaliation.

When a witness shares their experience with investigators during an investigation, they are participating in the fact-gathering process and their testimony may be considered as evidence.

Reponsible Employee Witnesses

Witness Participation

The University invites witnesses to participate in investigation processes. The University will not compel an individual to participate in the investigation.

The Office of Civil Rights and Title IX Compliance (OCR) will draw no adverse inference from a decision by any party or witness not to participate. However, if either Party declines to participate or limits the extent of their participation, such decision may limit the ability of OCR to thoroughly investigate and resolve the complaint.
